1. Acceptance of These Terms

By creating an account, accessing, or using Bitrise Biz (bitrisebiz.com), you agree to be bound by these Terms & Conditions and any applicable policies referenced in them.

If you are using Bitrise Biz on behalf of a business or other organisation, you confirm that you have authority to accept these Terms on its behalf.

2. The Bitrise Biz Service

Bitrise Biz is a software-as-a-service platform designed to help businesses manage operations such as inventory, sales, products, customers, invoices, reports and supplier communication.

Features may change over time as we improve the platform, introduce new functionality, address security requirements, or discontinue features that are no longer practical or supported.

3. Accounts and Account Security

You are responsible for providing accurate information when creating and maintaining your account.

• Keep your login credentials confidential.
• Do not share your account with unauthorised persons.
• Notify us promptly if you suspect unauthorised access.
• Ensure that people using your business account have appropriate permission.
• You are responsible for activity carried out through your account, except where caused by our failure to meet applicable security obligations.

4. Your Business and Merchant Data

You retain your rights and ownership in the business information, product information, sales records, customer information and other content that you submit to Bitrise Biz, subject to the rights needed for us to operate the Service.

You are responsible for ensuring that you have the necessary rights, permissions and lawful basis to enter customer, employee, supplier or other personal information into the platform.

We will process personal data in accordance with our Privacy Policy and applicable Kenyan data protection requirements.

5. Acceptable Use

You agree not to use Bitrise Biz to:

• Break or attempt to bypass applicable laws or regulations.
• Gain unauthorised access to another account, system or network.
• Upload malicious code, viruses, malware or other harmful material.
• Interfere with the security, availability or normal operation of the Service.
• Use automated methods to abuse, overload, scrape or disrupt the platform without our written permission.
• Impersonate another person or business.
• Store or process information that you are not legally entitled to process.

We may restrict or suspend access where reasonably necessary to protect the platform, other users, our service providers, or to comply with law.

6. Subscriptions, Fees and Payments

Where Bitrise Biz is offered as a paid service, the applicable subscription price, billing period and payment terms will be presented to you before or during subscription.

• Subscription fees are payable according to the billing terms applicable to your plan.
• You are responsible for providing accurate billing information.
• Applicable taxes, statutory charges or transaction fees may apply where required by law or by the relevant payment provider.
• Cancellation and refund terms, where applicable, will be communicated as part of the relevant plan or transaction.

We may change pricing for future billing periods by providing reasonable notice through the platform, email or another appropriate communication channel.

7. Third-Party Services and Integrations

Bitrise Biz may connect with third-party services, including Google services used for supplier email communication. Your use of a third-party service may also be subject to that provider's terms and privacy policies.

Where you authorise an integration, you are responsible for ensuring that the connected account belongs to you or that you have permission to connect it.

You may disconnect supported integrations through the available controls in Bitrise Biz or through the relevant third-party account settings.

8. Intellectual Property

Bitrise Biz, including its software, interface, branding, logos, designs, documentation and original platform content, is owned by or licensed to Bitrise Biz and is protected by applicable intellectual property laws.

Your use of the Service does not transfer ownership of Bitrise Biz's intellectual property to you. We grant you a limited, non-exclusive, non-transferable right to use the Service for your legitimate business operations during your active subscription or authorised access period.

9. Service Availability and Maintenance

We aim to keep Bitrise Biz secure and available, but we do not guarantee uninterrupted or error-free operation at all times.

The Service may occasionally be unavailable because of maintenance, upgrades, security incidents, infrastructure failures, internet connectivity problems, third-party service interruptions, or events outside our reasonable control.

Where reasonably practical, we will take steps to restore affected services and communicate significant service interruptions.

10. Suspension and Termination

You may stop using Bitrise Biz or request closure of your account in accordance with the applicable account or subscription process.

We may suspend or terminate access where reasonably necessary because of serious or repeated violations of these Terms, suspected abuse, security risks, non-payment, legal requirements, or circumstances that materially threaten the Service or other users.

After termination, your data will be handled in accordance with our Privacy Policy and applicable retention requirements. Where an export facility is provided, you should export required business records before the applicable deletion period expires.

11. Disclaimers and Limitation of Liability

Bitrise Biz provides software tools to help you manage business operations. The platform does not replace your responsibility for accounting, tax, legal, regulatory, stock-control or business decisions.

You are responsible for reviewing information entered into the system, including prices, stock quantities, customer information, invoices, sales records and reports.

To the extent permitted by applicable law, Bitrise Biz will not be responsible for indirect, incidental, special or consequential losses arising from your use of the Service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under Kenyan law.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Kenya, unless applicable law requires otherwise.

We encourage you to contact us first so that we can attempt to resolve any complaint or dispute informally. If a dispute cannot be resolved informally, it may be referred to the appropriate courts or dispute resolution process with jurisdiction under Kenyan law.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, business practices, security requirements or applicable law.

Where changes are material, we will take reasonable steps to notify users through the platform, email or another appropriate channel. The updated Terms will show a revised "Last Updated" date.
